SCA 291/2018

This case involved the accuracy of an expert's calculation of profits owed to partners in a company.

Background

The legal representative of some claimants filed a case against two defendants before the court. He requested the court to order the defendants to pay the claimants 85000000 Riyals. He said that the profits of the company in which the claimants and the defendants were partners was above 230000000 Riyals.

The court appointed an expert in order to consider the dispute between the two parties. The expert concluded that the defendants owed 85000000 Riyals to the claimants.

Decision

The court ruled that the defendants should pay the claimants the amount in addition to the expenses of the case of 440000 Riyals.

The legal representative of the defendants appealed the ruling before the court of appeal claiming that the standards upon which the expert had calculated the profits were inaccurate.

The court dismissed this argument and upheld the appealed ruling.
