SCA 2628/2019
This case involved non-payment for customs clearance work. A key issue was the validity of the evidence as photocopies had been used and the taking on an oath.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay 173000 Riyals. He said that he had finished customs clearance work for the defendant but the latter had failed to commit to his obligations.
The defendant denied the claims made by the claimant.
The court said that the case documents revealed that the documents provided by the claimant were all photocopies. The court said that Article 147 of Saudi Arabia Cabinet Decision No. 11/1435 stipulated that each photocopy that had not been approved by the relevant authority could not be considered as an evidence. The court said that the claimant had requested the defendant should take the oath but the latter had failed to do so.
The court ruled that the defendant should pay the claimant 210750 Riyals.
