SCA 2446/2019
This case involved the execution of a ruling ordering the payment of an outstanding amount for the purchase of a factory. A reconsideration plea was filed but this did not automatically lead to suspension of the execution ruling.
Background
A claimant filed a case against a company before the court. He requested the court to order the company to pay him 6250000 Riyals. He said that he had sold a factory to the company and the company had failed to pay the remaining amount.
The court ruled that the company should pay the claimant the amount.
The company made a plea to the court in order to reconsider the case.
Decision
The court said that the company had failed to provide the court with evidence upon which the court could suspend the execution of the ruling. The court said Article 202 of Saudi Arabia Cabinet Decision No. 11/1435 stipulated that filing a plea should not necessarily result in the suspension of the execution ruling.
The court dismissed the plea.
The Court of Appeal – Riyadh upheld the ruling based on the same grounds.
