SCA 240/2019
This involved an individual who had not paid the full amount for goods he had purchased. The purchaser claimed a minimal amount was outstanding but failed to to prove that so the claimant was asked to take the oath.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 27300 Riyals. He said that the defendant had bought a washing machine from him and he had failed to pay the full amount.
The defendant said that he had almost paid the full amount for the washing machine and that the remaining amount did not exceed 1000 Riyals.
Decision
The court said that the case documents revealed that the defendant had failed to prove his claim. The court requested the claimant take the oath. The claimant took the oath that his claim was valid.
The court ruled that the defendant should pay the claimant the mentioned amount.
The Court of Appeal – Medina had upheld the ruling based on the same grounds.
