SCA 2409/2019
This case involved the breach of an investment agreement which covered a wedding hall. As the contract involved a particular property it was not classed as commercial and the commercial court lacked jurisdiction.
Background
A claimant filed a case against a company before the court. He requested the court to order the company to pay him 290000 Riyals. He said that he had paid the company money in in order to invest it in a wedding hall but the company had failed to commit to their obligations.
Decision
The court said that the case documents revealed that the claimant had paid money to the company in order to invest it in a wedding hall. The court said that if the investment was related to a certain property, the commercial court should not consider the case according to Notification No. 3392/1439.
The court ruled that the consideration of the case did not fall under their jurisdiction.
The Court of Appeal – Riyadh upheld the ruling based on same grounds.
