SCA 2312/2019
This case involved a failure to pay when a contract was completed. As the company worked it real estate the court lacked jurisdiction.
Background
A claimant filed a case against a company before the court. He requested the court order the company to pay 451550 Riyals. He said that he had finished a project for the company but the company had failed to commit to their obligations. He also requested the court to order the company to pay compensation in addition to the expenses of the lawyer.
The company provided the court with a document in which the claimant pledged not filed any case against the company before the court.
Decision
The court dismissed the case.
The claimant appealed the ruling before the court of appeal.
The court said that the case documents revealed that the case was filed by a company that worked in real estate. The court said that the company therefore could not be considered a commercial one.
The court said that the consideration of the case dids not fall under its jurisdiction of the commercial court according to Article 35 of Saudi Arabia Cabinet Decision No. 11/1435.
The court repealed the ruling.
