This case involved the breach of a medical material supply contract. The dispute did not involved a commercial activity and the defendant was not a merchant.
Background
A company filed a case against a defendant before the court. The company requested the court to order the defendant to pay 58165 Riyals. The company said that they had supplied the defendant with medical materials and that the defendant had failed to pay their value.
Decision
The court said that the case documents had revealed that the dispute between the two parties was not related to a commercial activity. The court said that the case documents also revealed that the defendant was not a merchant. The court said that the court therefore did not have the jurisdiction to consider the case.
The court ruled that the consideration of the case did not fall under their jurisdiction.
The Court of Appeal – Riyadh upheld the ruling based on same grounds.
