SCA 2205/2019

This case involved the ratification and nullification of an arbitration ruling.

Background

A claimant requested the court of appeal to ratify an arbitration ruling and to refer the case to the department. The court asked the defendant if he had filed a nullification request against the said arbitration ruling and he confirmed that he had not but he had submitted a request to interpret some of the provisions of the arbitration ruling and to cancel some of its paragraphs and correct it before the arbitration authority.

Decision

The court said the provisions of Article 50 of Saudi Arabia Royal Decree No. M34/1433 and dated 16/04/2012 provided that a nullification case could only be accepted against an arbitration ruling in certain cases and mentioned these cases. The court said by considering the request of the claimant to ratify the arbitration ruling the court had concluded that this ruling should be upheld and should be implemented.
