This case involved the failure of a medical centre to pay a company for training. The medical centre was not a merchant so the court lacked jurisdiction.

Background

A company filed a case against a medical centre before the court. The company requested the court to order the centre to pay an amount of money. The company said that the two parties had agreed on a contract according to which the company would train the centre staff. The company said that the centre had failed to commit to their obligations.

Decision

The court said that the case documents revealed that the dispute between the two parties was not related to a commercial activity. The court said that the defendant was not a merchant. The court said that the court did not have the jurisdiction to consider the case according to Article 31 of Saudi Arabia Cabinet Decision No. 11/1435 .

The court ruled that the consideration of the case did not fall under their jurisdiction.

The court of appeal Riyadh upheld the ruling based on same grounds.
