SCA 2192/2019 issued on 14/05/2019
This case involved whether a partner had the right to see the financial reports of his company.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to give him the financial reports of their company and pay him compensation. He said that he and the defendant were partners in a company and that he had became unable to manage the company properly after he got sick. He said that the defendant had exploited his illness and refused to pay him his share in the profits or to let him see the financial reports.
Decision
The court said that the case documents revealed that the defendant had failed to permit the claimant to see the company's financial reports. The court said that the claimant had the right to see the company's financial report according to Article 73 of the Law of Companies.
The court ruled that the defendant should permit the claimant to see the financial reports of the company.
The court of appeal has upheld the ruling based on the same grounds.
