SCA 217/2019
This case involved non-payment of the full amount for purchased goods. Some of the bills had been signed and goods received by the defendant's employees. The defendant had not proved non-receipt.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 41533 Riyals. He said that he has supplied goods to the defendant but they failed to pay the full amount.
The defendant admitted that existence of the transaction but he said that he only owed 20000 Riyals.
The court said that the case documents revealed that the claimant had provided the court with the documents that proved his claims. The court said that some of the bills were signed by the defendant's employees and that the defendant had assigned them to receive goods. The court said that the defendant had failed to prove his claim.
Decision
The court ruled that the defendant should pay the claimant the amount.
The Court of Appeal – Medina upheld the ruling based on the same grounds.
