SCA 2121/2019

The initial dispute involved unfinished construction work. The key issue was whether the case was filed by an irrelevant party.

Background

A company filed a case against a company before the court. The company requested the court to order the company to pay 3804944.99 Riyals. The company said that they had finished contracting work for the company but the latter had failed to commit to their obligations.

The second company said that the first company was an irrelevant party in the case. The company said that the contract was signed with a company that did not belong to the first company.

Decision

The court said that the case documents revealed that the company's claims were valid.

The court dismissed the case because it was filed by irrelevant party according to Article 76 of Saudi Arabia Cabinet Decision No. 11/1435.

The first company appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
