SCA 2081/2019

This case involved whether an advance payment for digging a well should be returned after the company stopped digging because of a water authority decision.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay 156000 Riyals. He said that he paid this amount as an advance payment to the defendant in order to dig a well of a depth of 900 meters. He said that the defendant had completed 30 meters only.

Decision

The court said that case documents revealed that the defendant had stopped digging due to a decision made by the water authority.

The court ruled that the defendant should pay the claimant the mentioned amount.

The defendant appealed the ruling before the court.

The court dismissed the appeal and upheld the appealed ruling.
