SCA 2045/2019

This case involved non-payment of an invested amount. The defendant admitted the existence of the contract but stated he was not responsible for collecting money from the partnership's clients and they had not paid for goods they purchased. Therefore, the defendant was not responsible for the failure to generate the income.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him an amount of money. He said that he had paid the defendant 200000 Riyals in order to invest and that the defendant paid him 43079 Riyals only.

The defendant admitted the existence of the contract between the two parties but he said that he did not have the responsibility for collecting the money from the clients.

Decision

The court said that the defendant's claim was valid. The court said that the case documents revealed that the clients of the partners had failed to pay for the value of the goods sold to them. The court said that the defendant should not bear the responsibility for this failure.

The court dismissed the case.
