SCA 2036/2019

The initial dispute involved deductions from an amount owed for a construction contract and request to transfer ownership of plant used in the project. The court had ruled more than the company requested. The appeal was dismissed as the company failed to attend the hearing.

Background

A company filed a case against a company before the court. The company requested the court to order the other company to pay 1512423 Riyals. They said that the other company had deducted  this amount from the final bill for projects that the company conducted. They also requested the court to order the company to transfer ownership of three diggers.

The other company said that it deducted the amount because the company had caused them losses.

The first company then requested the court to order the other company to pay 1029526 Riyals.

The court ruled that the other company should pay 1512423 Riyals and that it should transfer the ownership of the diggers to the company.

The other company appealed the ruling before the court of appeal. It said that the court had ruled that it should pay 1512423 Riyals though the company only requested 1029526 Riyals.
