SCA 202/2019

This case involved non-payment for goods where it was claimed a discount had been given. The defendant refused to take the oath but the claimant took it.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 214882 Riyals in addition to compensation of 50000 Riyals. He said that he had supplied goods to the defendant but he had failed to pay.

The defendant admitted that transaction but he said that the claimant had given a discount of 100000 Riyals to him.

Decision

The court said that the case documents revealed that the defendant had failed to prove his claims about the discount. The court said that the defendant requested the claimant to take the oath to deny the claims about the discount. The court said that the claimant took the oath.

The court ruled that the defendant should pay the claimant 214882 Riyals.

The Court of Appeal – Tabuk upheld the ruling based on the same grounds.
