This case involved a travel ban requested on two individuals who were managers of a company which had failed to pay the full amount for purchased concrete.
Background
A company filed a case against two defendants before the court. The company said that they had supplied the defendants with concrete and that they had failed to pay the contract value. The company requested the court to prevent the defendants from travelling. The company said that the defendants were the mangers of the company that had received the concrete.
Decision
The court said that Article 208 of Saudi Arabia Cabinet Decision No. 11/1435 stipulated that the claimant had the right to request the judge to prevent the defendant from travelling abroad and that the judge had to issue this order if the legal reasons existed. The court said that the reasons for banning the defendants from travelling abroad existed in the case.
The court ruled that the two defendants cannot travel abroad.
The Court of Appeal – Jeddah upheld the ruling based on same grounds.
