The initial dispute involved money invested in a partnership which it was claimed had been spent and profits had not been made. An appeal was made but cancelled as the appellant failed to appear at the hearing.

Background

A claimant filed a case against a defendant before the court. She requested the court to order the defendant to pay her 50000 Riyals. She said that she had paid this amount as a share in the capital of a company in which the defendant was a partner. The claimant provided the court with documents that validated her claims.

The defendant said that he had used the money in order to buy electric appliances and that he lost the money and did not make any profits. The defendant failed to prove his claims.

Decision

The court ruled that the defendant should pay the claimant the mentioned amount.

The defendant appealed the ruling before the court of appeal. The defendant failed to attend the hearing of appeal.

The court dismissed the appeal in accordance with Article 190(1) of the Executive Appendix of the Law of Advocacy.

The court upheld the appealed ruling.
