SCA 1932/2019
This case involved how much should be paid to a defendant who had not completed a project. A key point was the defendant had taken the oath as requested.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 2620000 Riyals. He said that he had finished contracting work for the defendant but he had failed to commit to his obligations.
The defendant said that he had paid the claimant 3000000 Riyals but the claimant had finished 15% of the assigned work. He requested the court to order the claimant to pay him the amount he had paid.
Decision
The court said that the case documents revealed that the claimant had finished 20% of the assigned works. The court said that the claimant had failed to prove his claim. The court said that the claimant had asked the defendant to take the oath and the latter took it.
The court ruled that the claimant should pay the defendant 1664514.30 Riyals.
The court of appeal has upheld the ruling based on the same grounds.
