SCA 1911/2019
This case involved a claim that purchased goods had failed to match the required standards and the price was higher than market price. A key point was the claimant had reviewed the goods before signing the contract.
Background
A claimant filed a case against a defendant before the court. He requested the court to dismiss the contract he had signed with the defendant. He said that he had bought raw materials from the defendant and that he discovered that they did not comply with agreed standards. He also said that the price he had paid for the materials was above the market price.
The defendant admitted the claimant's claim but he said that the claimant had already sold on part of the raw materials he received.
Decision
The court said that the case documents revealed that the claimant had failed to prove his claims. The court said that the claimant had already admitted that he had bought the materials and reviewed them before signing the contract.
The court dismissed the case.
The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
