This case involved the amounts due to a former partner on the termination of a partnership where it was stated a cheque had been issued.
Background
A claimant filed a case against a defendant before the court. He said that he had agreed with the defendant to be partners in buying equipments and cars. He said that the two parties agreed that the claimant would be responsible for selling. He said that the partnership had then been dismissed and his share was determined as 3908547 Riyals. He requested the court to order the defendant to pay him this amount.
The court ruled that the defendant should pay the claimant 3817380 Riyals.
The defendant appealed the ruling before the court of appeal.
The court repealed the ruling and decided to reconsider the case again.
The claimant said that the defendant had signed a cheque with the value of the claimed amount. The defendant said that he had signed a blank cheque.
Decision
The court said that the case documents stated that the claimant provided the court with the mentioned cheque. The court said that two witnesses had also said that the defendant had issued the mentioned cheque.
