The initial request was to appoint an arbitrator in a dispute involving the building of schools. This was not classed as commercial so the court lacked jurisdiction.
Background
The claimant filed a claim requesting the defendants to appoint an arbitrator. The court said the dispute arose from a contract to build schools for the defendants which meant the dispute was not commercial because they were working in the education profession. The court said the jurisdiction was not with the commercial courts under the Saudi Arabia Royal Decree No. M34/1433 and the competent court was the one that had jurisdiction to consider the disputes that had been agreed on in the arbitration.
Decision
The Court of Appeal Riyadh issued a ruling that the commercial appeal court in Riyadh did not have the jurisdiction to settle this case.
