SCA 187/2019

This case involved a company which seized a car when it was claimed all the payments had been made. The key issue was which court had jurisdiction as the company was a finance company.

Background

A claimant filed a case against a company before the court. He requested the court to order the defendant to return his car. He said that the company had received all its entitlements according to a rental agreement signed between the two parties.

Decision

The court considered the documents of the case. The court said that the documents revealed that the company was a finance company. The court said that the Saudi Arabia Royal Decree No. M51/1433 stipulated that a special committee for the settlement of financing disputes should be formed in this regard.

The court said that the consideration of the case did not fall under its jurisdiction.

The claimant appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling
