SCA 1862/2019

This case involved an agency agreement. The claimant had depended on one witness and the defendant failed to attend the hearing so the claimant was asked to take the oath.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 26900 Riyals. He said that he had brokered a deal for the defendant but the defendant had failed to commit to his obligations.

The defendant failed to attend the court hearings.

Decision

The court said that the defendant had failed to attend the court hearings though he was informed of the case. The court said that the claimant's claim had depended on a testimony of one witness. The court said that the the testimony of one witness was not enough to prove the claim. The court therefore requested the claimant to take the oath. The claimant took the oath.

The court ruled that the defendant should pay the claimant the amount.

The court of appeal upheld the ruling based on the same grounds.
