SCA 184/2019
This case involved claims for compensation for a project which was it was claimed was delayed and there were issues with the finished work. The case would not be considered as this request had been previously considered and the claimant had failed to prove there had been a delay.
Background
A claimant filed a case against a contractor before the court. He requested the court to order the contractor to pay him compensation for failing to deliver a project within the agreed timing and compensation for shortcomings in the finished project.
The contractor requested the court to dismiss the case. He said that the case had been previously settled.
Decision
The court said it will not consider the request concerning the shortcomings in the finished project according to Article 62 of Saudi Royal Decree No. M1/1435 because this request had already been considered. The court said that the claimant had failed to prove his claim regarding the delay in delivering the project.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal.
The court dismissed the appeal and upheld the appealed ruling.
