SCA 1810/2019
This case involved whether an investor should be paid money by a business they had invested in. The business had been suspended but this was due to the defendant's negligence.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 189820 Riyals. He said that he had paid the defendant this money in order to invest it for him but the latter had failed to commit to his obligations.
The defendant admitted that he had received amount of money from the claimant but he claimed that his commercial activity in Saudi Arabia had been suspended and this had caused him losses.
Decision
The court said that the defendant had already admitted that he had received money from the claimant in order to invest it. The court said that the case documents revealed that the defendant's commercial activity had been suspended due to their neglect.
The court ruled that the defendant should pay the claimant the mentioned amount.
The Court of Appeal – Jeddah had upheld the ruling based on the same grounds.
