SCA 1806/2019

The initial dispute involved an investment which had been made but it was said agreed profits had not been paid. The defendant had lent the money to others who he had filed cases against which were being executed. The case was dismissed for being prematurely filed.

Background

A claimant filed a case against a defendant before the court. He said that he had paid the defendant 1000000 Riyals in order to invest in them in exchange for a profit. He said that the defendant had failed to pay him any profits over the last five years. The claimant requested the court order the defendant to pay him the mentioned amount. He said that the defendant had lent the money to other people.

Decision

The court ruled that the defendant should pay the claimant the amount.

The defendant appealed the ruling before the court of appeal. He said that he had filed cases against the debtors and that these cases were being executed. He said that he was ready to pay 250000 Riyals now to the claimant and that he did not have a bad intention against the claimant.
