SCA 1794/2019

This case involved non-payment of profits after money was invested in a company. The company claimed they had paid profits to the claimant. The claimant provided bills and took the oath to prove their claim.

Background

A claimant filed a case against a company before the court. He requested the court to order the company to pay him 65000 Riyals. He said that he had paid this amount to the company in order to invest it but they had failed to commit to their obligations and to pay him profits.

The company said that they had already paid the claimant 40165 Riyals. The company requested the court to dismiss the case.

Decision

The court said that the case documents revealed that the claimant had provided the court with all the bills that proved his claim. The court said that the company had failed to prove their claims. The court said that the claimant had also taken the oath in order to prove their claims.

The court ruled that the company should pay the claimant the amount.

The Court of Appeal – Mecca upheld the ruling based on the same grounds.
