This case involved the rental of a stadium which had not been maintained as was contracted. The parties were not merchants and this was not a commercial activity so the court lacked jurisdiction.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay 50000 Riyals and to maintain the disputed stadium. He said that the defendant had rented stadium from him and he had failed to commit to his obligations as stipulated in the contract.

The court said that the case documents revealed that the two parties were not merchants and that the dispute between them was not related to a commercial activity. The court said that the court did not have the jurisdiction to consider the case according to Article35 of Saudi Arabia Cabinet Decision No. 11/1435 .

Decision

The court ruled that the consideration of the case did not fall under their jurisdiction.

Court of Appeal – Jeddah upheld the ruling based on same grounds.
