SCA 172/2019 issued on 30/07/2019

This case involved unpaid contracting work. A key issue was the accuracy of the claimed amount and the work of the expert.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 1106980.48 Riyals. He said that he had finished contracting work for the defendant and that the latter had failed to commit to his obligations.

The defendant admitted the existence of the transaction but he said that the amount the claimant had requested was inaccurate.

Decision

The court said that the case documents revealed that the defendant had denied the bills provided by the claimant. The court said that the report of the expert concluded that the bills were valid.

The court ruled that the defendant should pay the claimant the mentioned amount in addition to the expert's expenses

The Court of Appeal – Dammam upheld the ruling based on the same grounds.
