SCA 1687/2019

This case involved construction work which it was claimed had not been paid for in full. The company which owned the property intended to rent it out as flats. Therefore the dispute did not come under the jurisdiction of this court.

Background

A company filed a case against a company before the court. The company said that they had finished a project for the company but the latter failed to pay the value of the contract. They requested the court to order the company to pay 25126.25 Riyals.

The court ruled that the company should pay the company the amount.

The company appealed the ruling before the court of appeal.

Decision

The court said that the case documents revealed that the second company was the owner of the disputed property and that they wanted to finish the mentioned project in order to rent the property as flats.

The court said that the consideration of the case did not therefore fall under the jurisdiction of the commercial court.

The court repealed the ruling.
