This case involved whether it was possible to request the suspension of execution of a ruling where there had been a reconsideration plea.
Background
A defendant submitted a reconsideration plea to the court. The court accepted the plea. The defendant then requested the suspension of the execution of the ruling issued against him.
The court said that the case documents revealed that the request made by the defendant to suspend the execution of the ruling met the legal conditions of urgency and seriousness. The court said that Article 202(2) of Saudi Arabia Cabinet Decision No. 11/1435 stipulated that was possible for the court to suspend the execution of a ruling if one of the disputed parties requested so
Decision
The court ruled that the execution of the ruling should be suspended.
The Court of Appeal – Jeddah upheld the ruling based on same grounds.
