This dispute involved the failure to pay for the rental of land and a request that an arbitrator be appointed. As the dispute did not relate to a commercial activity the court lacked jurisdiction.
Background
Some claimants filed a case against a defendant before the court. They said that the defendant had rented land from them and failed to pay the rent. They requested the court to appoint an arbitrator for the defendant.
Decision
The court said that the case documents revealed that the dispute between the two parties was not related to a commercial activity. The court said that the court therefore did not have the jurisdiction to consider the case according to Article 35 of Saudi Arabia Cabinet Decision No. 11/1435
The court ruled that the consideration of the case did not fall under their jurisdiction.
Court of Appeal – Jeddah upheld the ruling based on same grounds.
