SCA 1664/2019
This case involved a request to stop a cheque until arbitration which had been requested was over. Issues included whether the request relating to the cheque had a suitable reason and if the case had been put before the wrong court.
Background
The claimant submitted a claim requesting the defendant to accept arbitration and stop a cheque until the arbitration was over.
Decision
The court stated that the request of the claimant to ask the defendant to stop the cheque violated Article 5 of Saudi Arabia Royal Decree No. M34/1433. It became evident that the request to stop the check was without a suitable reason and that it was a commercial document and payment instrument. The document also showed that the address of the defendant was in Jeddah.
Appeal Court of Riyadh issued a ruling rejecting the case and dismissing the request to stop the cheque.
