SCA 1662/2019
This case involved a cheque issued after project work was done for a company which had bounced. A key point was the defendant was not the owner of the company.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 405000 Riyals. He said that the defendant had issued a cheque to him because he had finished work on a project which belonged to the defendant. He said that the cheque had bounced
The defendant said that the consideration of the case did not fall under the jurisdiction of the commercial courts.
Decision
The court said that the case documents revealed that the defendant had claimed that he was not the owner of the company that the claimant had finished the works for. He said that the claimant had signed the contract with the company and therefore he was irrelevant party in the case. The court said that the claimant admitted that the defendant was not the owner of the company.
The court dismissed the case.
The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
