SCA 1637/2019
This case involved a claim by an investor for repayment of capital and profits. The defendant stated the business had made losses. The defendant was asked to prove investments he had made but failed to do so. However, case documents that proved the claimant had received some money from the defendant were critical.
Background
A claimant filed a case against a company before the court. He requested the court to order the company to pay him capital and profits. He said that he had paid the defendant 600000 Riyals to invest but the defendant had failed to commit to their obligations.
The defendant admitted the existence of the transaction but he said that the business had made large losses.
Decision
The court said that they had requested the defendant to provide evidence that he had invested the amount but he had failed to do so.
The court ruled that the defendant should pay the claimant the amount.
The court of appeal said that the case documents revealed that the claimant had received 12000 Riyals from the defendant.
The Court of Appeal – Mecca repealed the ruling.
