SCA 1635/2019
This case involved a failure to pay the full amount for the installation of elevators. It was claimed the claimant had failed to carry out agreed changes. The claimant's evidence and the defendant's failure to prove their counterclaim led to the requested amount being due.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 369000 Riyals. He said that he had installed 16 elevators for the defendant and that the latter had failed to pay the full value of the contract.
The defendant admitted the transaction but he said that the claimant had failed to execute some the changes which they had requested defendant.
Decision
The court said that the case documents revealed that the claimant had executed all his obligations according to the contract. The court said that the defendant had failed to prove his claims.
The court ruled that the defendant should pay the claimant the mentioned amount.
The Court of Appeal – Mecca up held the ruling based on the same grounds.
