SCA 1625/2019

This case involved non delivery of purchased raw materials. The oath was taken by the claimant to prove his case.

Background

A claimant filed a case against a company before the court. He requested the court to order the company to pay him 215000 Riyals. He said that he had bought raw materials from the company but the latter had failed to supply him with the materials.

The company said that she delivered raw materials which were valued at 15441163 Riyals to the claimant. The company said that they owed him 95000 Riyals .

Decision

The court said that the case documents revealed that the claimant had provided the court with all the bills and that these bills were signed by the company. The court requested the claimant to take the oath in order to prove his claims. The claimant took the oath.

The court ruled that the company should pay the claimant the amount.

The Court of Appeal – Mecca upheld the ruling based on the same grounds.
