SCA 1592/2019

This case involved the failure to pay for construction work where the defendant denied the claims but the oath was taken.

Background

A company filed a case against a company before the court. The company requested the court to order the other company to pay 295000 Riyals. The company said that they had finished digging work for the other company but the latter had failed to commit to their obligations.

The other company denied the claims made by the company.

Decision

The court said that the case documents revealed that the representative of the company had requested the other company to take the oath in order to deny the claim. The court said that the other company refused the request and asked for the representative of the company to take the oath in order to prove the claim instead. The representative of the company took the oath.

The court ruled that the other company should pay the company the amount.

The Court of Appeal – Jeddah upheld the ruling based on same grounds.
