SCA 1588/2019
This case involved a request for compensation as it was claimed a shop had been purchased but the shop license had not been transferred to the purchase. There was no evidence the seller had not fulfilled their contractual obligations.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him compensation. He said that he had bought a shop to operate as a car wash from the defendant had failed to commit to his obligations. He said that the defendant failed to proceed with the proceedings to transfer the shop license of the shop to him.
The defendant denied the claims made by the claimant.
Decision
The court said that the case documents revealed that the defendant had committed to all his obligations as stipulated in the contract. The court said that the claimant failed to prove his claims.
The court dismissed the case.
The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
