This case involved whether the required grounds were present for a partner to submit a plea for reconsideration of a ruling.

Background

A convicted person submitted a plea for reconsideration to the court. He said the court had established the ruling issued against him on the grounds of invalid reasons. He said that he did not request the court to order the company to pay his partnership entitlements but he had requested them to pay his share of the profits.

Decision

The court said that the disputed parties had the right to submit a plea for the reconsideration of the ruling issued by the courts. The court said that the plea submitted by the convicted person, however, had not complied with the categories stipulated by Article 200 of Saudi Arabia Cabinet Decision No. 11/1435 on the acceptable reasons for submitting a plea.

The court dismissed the plea.

The Court of Appeal – Jeddah upheld the ruling based on same grounds.
