SCA 1569/2019
This case involved the dismissal of communications bills. The communications authority and not the court had the jurisdiction to hear the case.
Background
A company filed a case against another company before the court. The company requested the court to order the other company to dismiss the value of the bills issued to them.
Decision
The court said that Article 10 of Saudi Arabia Royal Decree No. M12/1422 stipulated that the communication authority should consider the disputes between the customers and the communications companies.
The court said that the case documents revealed that the dispute between the two parties was related to communications bills. The court said that the court did not have the jurisdiction to consider the case according to Article 35 of Saudi Arabia Cabinet Decision No. 11/1435
The court ruled that the consideration of the case did not fall under their jurisdiction.
The Court of Appeal – Jeddah upheld the ruling based on same grounds.
