SCA 1565/2019 issued on 12/06/2019
This case involved money owed to some heirs by their father's former partner. The heirs provided a document which included an admission as evidence and the defendant had failed to attend the court hearing.
Background
The heirs of a deceased man filed a case against a defendant before the court. They requested the court to order the defendant to pay 460000 Riyals. They said that their father had been a partner of the defendant's in a business and that latter owed the amount.
Decision
The court said that the case documents revealed that the heirs had provided the court with a document in which the defendant admitted that he owed the amount. The court said that the defendant had failed to attend the court hearings though he was informed of the case.
The court ruled that the defendant should pay the heirs the amount.
The Court of Appeal – Jeddah upheld the ruling based on same grounds.
