This case involved whether when a defendant had bought goods for company but not paid for them, the company could be required to pay too. The defendant was the husband of the company owner and bought the goods through sales orders.
Background
A claimant filed a case against a defendant and a company before the court. He said that he had supplied the defendant with machine oil in order to supply it to the company. He said that the defendant had failed to pay him the value of oil. He requested the court to order the company to pay him 113550$ in addition to the expenses of the lawyer.
The company said that the defendant was not authorized to make commercial deals on the company's behalf.
Decision
The court said that the case documents revealed that the defendant was the husband of the company owner. The court said that the documents also revealed that the defendant had bought the mentioned oil for the company though sale orders.
The court ruled that the company should pay the claimant the amount.
The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
