Background
A claimant filed a case against a defendant before the court. He said that the defendant worked for him and he had assigned him to sell goods on his behalf. He said that the defendant had sold the goods but he had failed to pay their value to him. He requested the court to order the defendant to pay 6500000 Riyals.
Decision
The court said that the case documents revealed that the defendant was working for the claimant and therefore the relationship between the two parties was not a commercial one. The court said that the court therefore did not have the jurisdiction to consider the case according to Article 443 of Saudi Arabia Royal Decree No. M32/1350 and Article 35 of Saudi Arabia Cabinet Decision No. 11/1435 .
The court ruled that the consideration of the case did not fall under their jurisdiction.
The Court of Appeal – Jeddah upheld the ruling based on same grounds.
