SCA 1500/2019

This case involved to breach of a partnership contract. A key issue was whether the correct procedure was followed for a plea.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay 100000 Riyals in addition to the profits. He said that he had paid the mentioned amount as a share in a partnership with the defendant. The claimant said that the defendant had failed to commit to his obligations according to the signed contract.

Decision

The court ruled that the defendant should pay the claimant 100000 Riyals and that the partnership contract should be dismissed.

The claimant made a plea to the court of appeal requesting the reconsideration of the case.

The court said that the plea did not comply with the cases stipulated by Article 200 of the Law of Advocacy.

The court dismissed the plea and upheld the appealed ruling.
