SCA 1496/2019

This case involved investment. The investment had been made via a broker. The defendant was asked to take the oath to prove he had not received the money but refused.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 130000 Riyals. He said that he had paid the defendant this amount in order to invest but the defendant had failed to commit to his obligations.

The defendant denied the claimant's claim and said that he had not received money from the claimant.

Decision

The court said that the case documents revealed that the claimant had paid the defendant 60000 Riyals via a broker. The court said that the claimant had failed to prove that he paid 130000 Riyals. The court said to the claimant could ask the defendant to take the oath in order to deny his claims. The defendant failed to take the oath.

The court ruled that the defendant should pay  130000 Riyals.

The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
