SCA 1489/2019
This case involved the purchase of goods where it was claimed there was an offset so payments were not due. The claimant provided evidence and there was a costs order.
Background
A company filed a case against a company before the court. The company requested the court to order the other company to pay 545350 Riyals. The company said that they had supplied the company with chemical materials but the latter failed to pay their value.
The other company denied the claims made by the first company. The company said that the two parties had reached a different agreement regarding other payments.
Decision
The court said that the case documents revealed that the first company had provided the court with all documents that proved her claims. The court said that the documents also revealed that the second company had failed to prove their claims.
The court ruled that the other company should pay the company the mentioned amount in addition to the expenses of the lawyer of 25000 Riyals.
The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
