SCA 1465/2019

This dispute involved the amount of work carried out under a service contract and if it had been paid. Witnesses used as evidence of the claim were disputed and an appeal was not made within the required deadline.

Background

A claimant filed a case against a company before the court. He requested the court to order the company to pay him 239027 Riyals. He claimed that he had completed work for the company but they failed to commit to its obligations according to the signed contract.

The legal representative of the company claimed that the value of work was only 67500 Riyals. He said that the company had already paid part of the mentioned amount through two instalments.

The legal representative of the company requested the claimant to validate his claim. The claimant brought two witnesses to the court to validate his claim but the legal representative of the company rejected their testimonies.

The court said that the claimant had failed to validate his claim in accordance with Article 35 of the Law of Advocacy.

Decision

The court dismissed the case.
