SCA 1448/2019
The initial dispute involved ta contract for the construction of a sewage treatment plant. The defendant had refused a request to settle the dispute amicably. It was said they had also refused to appoint an arbitrator. As they had appointed an arbitrator the case was over.
Background
The representative of the claimant filed a claim with this court requesting the appointment of an arbitrator for the defendant (contracting company) for a dispute which had arisen because of the contract between them. The contract was concluded for sewage treatment plant. The claimant wanted to settle the dispute amicably but the defendant had refused to do so. The defendant was also refusing to appoint an arbitrator. However, the representative of the defendant attended the hearing and confirmed that his client had appointed an arbitrator.
Decision
Appeal Court of Riyadh stated the dispute was over arbitration and it is under its jurisdiction according to Article 8 of Saudi Arabia Royal Decree No. M34/1433 and given that the defendant had accepted the request of the claimant and appointed an arbitrator the case was over.
The court issued a ruling that the case was over.
